Welcome to imagi (the "App"). imagi Education, Inc. ("imagi Education," "we," "us," or "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, share, and protect information in relation to the imagi mobile application and related services (collectively, the "Service").

By using the Service, you understand and agree that we provide a platform for you to create and post content, including coding projects, comments, and other materials ("User Content"), and to share User Content with other users. Other users may search for, view, use, or share any User Content that you make publicly available through the Service, consistent with this Privacy Policy and our Terms and Conditions.

This Privacy Policy applies to all visitors, users, and others who access the Service ("Users"). Please read this Privacy Policy carefully. If you do not agree with the practices described herein, please do not use the Service.

2. Information We Collect

2.1. Information You Provide Directly

• Account Information: Your username, password, email address or phone number, and date of birth when you register for an account.

• Profile Information: Information you provide for your user profile (e.g., bio, age). This information may allow you or others to be found on the App.

• User Content: Coding projects, comments, and other materials that you create and post through the Service.

• Communications: Correspondence between you and imagi Education, including support requests and feedback. We may also send you Service-related communications (e.g., account verification, security notices, updates to features). You may not opt out of essential Service-related communications.

2.2. Information Collected Automatically

• Device Information: Information about the device you use to access the Service, including device type, operating system, unique device identifiers, and mobile network information.

• Usage Information: Information about how you use the Service, including the features you interact with, content you view, and the time and frequency of your activities.

• Analytics Information: We use third-party analytics tools to measure traffic and usage trends. These tools collect information sent by your device or the Service. We aggregate and use this analytics information in a manner that cannot reasonably be used to identify any particular individual User.

• With Your Consent: We may share your information for any other purpose with your explicit consent.

6. How We Store and Protect Your Information

Your information collected through the Service is stored and processed in the United States or in other countries where imagi Education or its service providers maintain facilities.

We implement commercially reasonable technical and organizational safeguards designed to protect the information we collect. These measures include encryption, access controls, and secure server infrastructure. However, no method of electronic transmission or storage is completely secure, and we cannot guarantee absolute security.

You are responsible for maintaining the confidentiality of your account credentials and for controlling access to your account. Please notify us immediately at support@imagilabs.com if you believe your account has been compromised.

7. Data Retention

We retain your personal information for as long as your account is active or as needed to provide you with the Service. We may also retain and use your information as necessary to comply with legal obligations, resolve disputes, enforce our agreements, and protect our legitimate business interests.

When your account is deleted, we will delete or anonymize your personal information within a reasonable timeframe, except where retention is required by law or for legitimate business purposes (such as fraud prevention or financial record-keeping).

Aggregated or de-identified information that can no longer reasonably be used to identify you may be retained indefinitely for analytics and service improvement purposes.

8. Children's Privacy (COPPA)

imagi Education is committed to protecting the privacy of children. The App is designed for users aged 13 and older. We comply with the Children's Online Privacy Protection Act ("COPPA") and related regulations.

8.1. Users Under 13

We do not knowingly collect personal information from children under the age of 13 without verifiable parental consent. If we learn that we have collected personal information from a child under 13 without appropriate consent, we will take steps to delete that information as promptly as possible.

8.2. Parental Rights

Parents and legal guardians of children under 13 have the right to:

• Review the personal information we have collected from their child.

• Request that we delete their child's personal information.

• Refuse to permit further collection or use of their child's personal information.

11. Rights for California Residents (CCPA/CPRA)

11.1. Your California Privacy Rights

• Right to Know: You may request that we disclose the categories and specific pieces of personal information we have collected about you, the sources of collection, the business purposes for collection, and the categories of third parties with whom we share your information.

• Right to Delete: You may request that we delete personal information we have collected from you, subject to certain exceptions.

• Right to Correct: You may request that we correct inaccurate personal information.

• Right to Opt Out of Sale/Sharing: We do not sell your personal information. We do not share your personal information for cross-context behavioral advertising purposes.

• Right to Non-Discrimination: We will not discriminate against you for exercising any of your privacy rights.

11.2. How to Submit a Request

To exercise your California privacy rights, please contact us at support@imagilabs.com. We will verify your identity before processing your request. We will acknowledge receipt within 10 business days and respond substantively within 45 calendar days (extendable by an additional 45 days with notice).

11.3. Categories of Information Collected

In the preceding 12 months, we may have collected the following categories of personal information: identifiers (username, email address, phone number), demographic information (date of birth), internet or electronic network activity information (usage data, device information), and user-generated content (coding projects, comments).

12. International Data Transfers

Your information may be transferred to and processed in countries other than your country of residence, including the United States. These countries may have data protection laws that differ from the laws of your jurisdiction.

Where required by applicable law, we implement appropriate safeguards for international data transfers, including Standard Contractual Clauses (SCCs) approved by the European Commission for transfers from the EEA, or other legally recognized transfer mechanisms.

By using the Service, you acknowledge that your information may be transferred to the United States and other countries where imagi Education or its service providers operate.

13. Third-Party Links and Services

The Service may contain links to third-party websites or services that are not owned or controlled by imagi Education. We are not responsible for the privacy practices of these third parties. We encourage you to review the privacy policies of any third-party services you access through the App.

14. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we make material changes, we will notify you by posting the revised policy and updating the version history at the bottom of this document, and where appropriate, by providing additional notice through the App or via email. Your continued use of the Service after any changes constitutes your acceptance of the updated Privacy Policy.
